Powell was sentenced to 6 years of probation, must pay a $6,000 fine, a $2,700 restitution to the state of Georgia, and must testify truthfully against other co-conspirators, including Donald Trump. She also must write an apology letter to the citizens of Georgia.

The new set of charges that Sidney Powell plead guilty to are not related at all by statute to the original charges and these new charges have no connection to Trump. The reason Sidney Powell had a trial scheduled earlier than Trump was because she had invoked her right to a speedy trial.

Looks like the prosecutor got rid of the original RICO charges because they simply cannot prove them and they don't want Trump's lawyers to be able to prepare an easy defense against baseless charges when Trump's RICO case come to trial.

Ken Cheseboro, disgraced Trump lawyer, has just pled guilty and turned states evidence against Trump in the Fulton county, Georgia election interference case. Michael Popok of Legal AF reports that as part of Cheseboro’s plea, he will receive a conviction for a felony for conspiracy to submit false papers, Meaning the fake electors certificates, and fully cooperate with the state attorney against Donald Trump and others for their role in the criminal conspiracy, in return for five years of probation and first offense status under Georgia law.

WHY ARE PROSECUTORS USING RICO?​

RICO was originally conceived as a tool to go after mafia kingpins who kept their hands clean by parking ill-gotten gains in shell corporations and leaving the dirty work to underlings.

The law does not require prosecutors to prove that defendants directly engaged in criminal activity, just that they were part of a larger organization that did.

That means prosecutors would not necessarily have to prove Trump personally broke the law but knowingly coordinated with others who did.

WHAT ARE THE RISKS OF USING RICO?​

RICO cases are inherently more complex because prosecutors must first prove the existence of a criminal enterprise.

The Trump indictment names an additional 18 co-defendants, including Trump's onetime lawyer Rudy Giuliani, his former chief of staff Mark Meadows and lawyer John Eastman.

Prosecutors will need to prove that Trump and his co-defendants worked together towards a common criminal purpose, which is not always as straightforward as proving an underlying RICO crime.

But each additional co-defendant is another that prosecutors could coax into testifying against the others.
